ChargeHub — Terms of Service

Welcome to ChargeHub. In these Terms of Service ("Terms"), "we", "us" and "our" refer to ChargeHub, and "you" refers to you, the customer. ChargeHub operates this store and website at chargehub.co.za, including all related content, features, tools, products and services (the "Services"). Our store is powered by Shopify.

These Terms, together with our Privacy Policy, Refund & Return Policy and Shipping & Delivery Policy, describe your rights and responsibilities when you use the Services. Please read them carefully, as they include important information about warranties, returns and limitations of liability. By visiting or using our Services, or by placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

1. Eligibility and account

By using the Services you confirm that you are at least 18 years old, or are using the Services under the supervision of a parent or guardian. When you place an order or create an account, you agree to provide accurate, current and complete information, and to keep your account details secure. You are responsible for all activity that takes place under your account.

2. Products and availability

We make every effort to display our products and their colours, features and specifications as accurately as possible. Actual appearance may vary slightly depending on your device and screen settings. All products are subject to availability, and we may change, limit or discontinue any product at any time without notice.

3. Orders and acceptance

When you place an order you are making an offer to purchase. All orders are subject to acceptance by us, and we may decline or cancel an order at our discretion — for example, if a product is unavailable, if there is an error in the price or description, or if we suspect fraud. Your order is only accepted once we confirm it and your payment has been received. If we cancel an order after payment, we will refund you in full.

4. Pricing and payment

All prices are shown in South African Rand (ZAR) and include VAT where applicable. Prices, discounts and promotions may change at any time, but the price that applies to your order is the price shown at checkout and confirmed in your order confirmation. Delivery fees are added at checkout in line with our Shipping & Delivery Policy. You confirm that you are authorised to use the payment method you provide and that the payment details are accurate. Payments are processed securely through our payment provider.

5. Shipping and delivery

We deliver across South Africa. Delivery times are estimates and are not guaranteed, and we are not liable for delays caused by couriers or other events beyond our control. Full details, including delivery times and rates, are set out in our Shipping & Delivery Policy. Risk in the products passes to you on delivery.

6. Returns and refunds

Your purchases may be returned, exchanged or refunded in accordance with our Refund & Return Policy, which forms part of these Terms. This includes your cooling-off rights and our handling of faulty or incorrect items.

7. Consumer rights and warranties

Nothing in these Terms limits any rights you have under the South African Consumer Protection Act (CPA) or the Electronic Communications and Transactions Act (ECTA). ChargeHub products carry a 6-month warranty against manufacturing defects. To the extent permitted by law, and except as expressly stated by us, the Services and products are provided on an "as is" and "as available" basis.

8. Intellectual property

All content on the Services — including text, images, graphics, logos, product descriptions, and the design and arrangement of the store — is owned by ChargeHub or its licensors and is protected by South African and international copyright and intellectual property laws. You may use the Services for your own personal, non-commercial use only. You may not copy, reproduce, distribute, modify or republish any part of the Services without our prior written consent. "ChargeHub" and our logo are our trademarks and may not be used without permission.

9. Acceptable use

You agree to use the Services lawfully and not to: use them for any unlawful or fraudulent purpose; infringe our rights or those of others; transmit false or misleading information; upload viruses or malicious code; attempt to gain unauthorised access to the Services; or interfere with the proper working of the Services. We may suspend or terminate your access if you breach these Terms.

10. Third-party links

The Services may contain links to third-party websites or tools that we do not control. We are not responsible for the content, products or practices of any third-party sites, and accessing them is at your own risk. Please review their terms and policies before transacting with them.

11. Disclaimer and limitation of liability

To the fullest extent permitted by law, ChargeHub is not liable for any indirect, incidental, special or consequential loss or damage, including loss of profits, data or goodwill, arising from your use of the Services or any products purchased through them. Where our liability cannot be excluded by law, it is limited to the amount you paid for the relevant order. Nothing in these Terms excludes liability that cannot be excluded under South African law.

12. Indemnification

You agree to indemnify and hold ChargeHub harmless from any claims, losses or expenses (including reasonable legal fees) arising from your breach of these Terms, your violation of any law, or your infringement of the rights of any third party.

13. Privacy

Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use and protect your personal information in line with the Protection of Personal Information Act (POPIA). By using the Services, you consent to that processing.

14. Changes to these Terms

We may update these Terms from time to time. The current version will always be available on this page, and your continued use of the Services after any change means you accept the updated Terms.

15. Governing law

These Terms are governed by and interpreted in accordance with the laws of the Republic of South Africa, and you consent to the exclusive jurisdiction of the South African courts.
